The requirement is rooted in the idea that excess capacity drives up healthcare costs, so states use the process to control where and how facilities grow.

To secure a CON, an applicant typically must demonstrate that the proposed project meets a genuine community need. The review can involve public comment, competing applications, and formal state evaluation.

Why does a Certificate of Need matter for an ASC?

In states that maintain CON laws, the approval process can be a significant barrier to entering or expanding in a market. An ambulatory surgery center may need to prove demand and clear a regulatory review before it can open, add operating rooms, or introduce a new specialty.
